There is a husband and wife on the west coast that has a wonderful daughter that has Down’s syndrome. They love her tremendously and wouldn’t trade her for anything in the world! They were told that she would be born healthy and normal. They tested because the mother was older, and was at a higher risk to have an unhealthy child. Had they known about the Down’s before, they would have aborted the fetus. They are now suing for wrongful birth.
I read a novel by Jodi Picoult called Handle With Care about a similar situation. The daughter was born with Osteogenesis Imperfecta or Brittle Bone Disease as it is most commonly known. The doctors missed the diagnosis and the mother in the story sued for wrongful birth.
The doctor did not test the fetus. The doctor instead tested the mother. If this error had not happened, this case would not exist. The family is receiving death threats over this case.
If put in the same situation, I would sue as well. If I were to know ahead of time that the blood test for my unborn child came back positive for this, I would abort the fetus. I do not have the funds or the ability to care for a child with a disability. I hope this couple wins this case.
